The Foundations of Bioethics (1986) inscrit la bioéthique dans un cadre très large. L'auteur prend acte de l'impossibilité, dans les sociétés contemporaines, de parvenir à un consensus général en éthique: il n’existe pas d’accord sur une conception du monde universellement recevable, rationnelle et dotée de contenu concret. Dans les sociétés laïques et pluralistes, les valeurs et les normes des individus diffèrent, parfois du tout au tout. Sous la seule exigence de résoudre les désaccords de façon pacifique, Hugo Tristram Engelhardt, Jr. distingue deux principes, différents mais complémentaires, qui permettent de construire à nouveaux frais une bioéthique acceptable.
Le principe d’autonomie met en avant la liberté, caractérisée non comme une valeur à promouvoir, mais comme une condition de possibilité de l’éthique. Formel et d’application universelle, il proscrit l’usage de la violence, privée ou étatique, à l’encontre des choix innocents, c’est-à-dire des choix qui ne causent pas de préjudice aux personnes. Le principe de bienfaisance, fondé sur la sympathie et l’intérêt pris à la traduire en acte, indique à quelles conditions on peut ou doit faire le bien d’autrui. Concret, il ne peut se réaliser effectivement que dans le cadre de communautés diverses, avant tout des communautés de croyants, où il prend des formes elles-mêmes diverses, éventuellement aberrantes aux yeux des membres des autres communautés.
La bioéthique reconstruite sur ces fondements est parfois conforme au sens commun et à une certaine sagesse médicale traditionnelle, mais elle en diffère souvent de façon radicale, en particulier par l’accent mis sur l’autonomie des personnes, par opposition à la condition qui est celle des êtres humains.
Hugo Tristram Engelhardt, Jr., né en 1941, est un philosophe américain. Docteur en philosophie et en médecine, il enseigne au Département de Philosophie de la Rice University (Austin). Four concrete examples of public controversy are considered in detail: the efficacy of Laetrile, the classification of homosexuality as a disease, the setting of safety standards in the workplace, and the utility of nuclear energy as a source of power. The essays in this volume show that debates about these cases are not confined to matters of empirical tact. Rather, as is seen with most scientific and technical controversies, they focus on and are structured by complex ethical, economic, and political interests.
Drs. Engelhardt and Caplan have brought together a distinguished group of scholars from the sciences and humanities, who sketch a theory of scientific controversy and attempt to provide recommendations about the ways in which both scientists and the public ought to seek more informed resolutions of highly contentions issues in science and technology. Scientific controversies is offered as a contribution to the better understanding of the roles of both science and nonscientific interests in disputes and controversies pertaining to science and technology.
